I can not wrap my head around the fact that selling a jersey for a tattoo and the coach lying about it is a lack of institutional control, but covering up for a known pedophile, on your payroll, putting other children at risk, and then playing the blame game afterward isn't.
You are free to define institutional control however you want, but the NCAA defines it as having all necessary procedures in place to promote compliance with NCAA rules. (paraphrased) Trading school issued memorabilia for tattoos is against NCAA rules, being a pederast is not. FWIW, the NCAA did not charge OSU with LOIC.
