You are free to define institutional control however you want, but the NCAA defines it as having all necessary procedures in place to promote compliance with NCAA rules. (paraphrased) Trading school issued memorabilia for tattoos is against NCAA rules, being a pederast is not. FWIW, the NCAA did not charge OSU with LOIC.
