Right, on Earth he's a superhero. But his powers can be changed based on conditions. The same can be said for Batman and Iron Man, it's just a little easier to change the conditions.

The more I think about it, most superheroes' powers can be nullified in one way or another, so I don't think that cuts the mustard as a necessary qualifier.
