If Notre Dame can be ranked in the top 10, then they have a chance to make the BCS playoffs. Notre Dame will always get a BCS bowl over schools like Tech and Wisconsin if the choice is between them and those schools since Notre Dame is a national brand. I can only see a few schools like Alabama and Texas actually beating out Notre Dame for an at large bowl spot. Even after 20 years of mediocrity, Notre Dame is still the media darling and will receive special consideration.
but as you said, so will 'Bama and Texas and USC-w, etc...they're not the only one getting special consideration. Notre Dame is technically representing the independent schools (though we all know that means they are looking out for themselves). i get that, but i don't think it's anyone's place to force a university to join a league. the simply way to ensure Notre Dame earns it is to create rules, either for the poll used or for the selection committee. #10 ND isn't going to get picked over a #4 school. beyond that, ND won't get any treatment that Michigan, Texas, 'Bama, tOSU, etc wouldn't also get. their independence has nothing to do with that.

if you forced them into a league, you would likely be making their schedule EASIER and they would STILL get the same preferential treatment they get today...
